Novotel: Contest Rules
WIN YOUR WEDDING CONTEST IS OFFERED ONLY IN CANADA (EXCLUDING QUEBEC). VOID WHERE PROHIBITED.
CONTEST TIMING: Contest will begin on January 1, 2006 and will end at 11:59 PM EST on December 31, 2007 ("Contest Period"). Accor Canada, Inc. (“Accor”) and its Administrators may alter the duration of the contest period at any time.
SPONSOR: The contest will be audited and the drawing will be conducted by QVS Promotions 275 Renfrew Drive, Ste 104 Markham, Ontario L3R 0C8 (the “Adminsitrator”).
ELIGIBILITY: Open only to legal residents of Canada (except Quebec residents) and who are 18 years of age or older as of date of entry. Employees (and the immediate families [spouses and parents, siblings and children and their spouses] and members of the same household of such employees) of Accor ("Sponsor"), it's divisions, affiliates, subsidiaries, advertising and promotion agencies are not eligible to enter. Void where prohibited by law. Promotion is subject to all federal, provincial, local laws and regulations.
AGREEMENT TO THE OFFICIAL RULES: By participating in the Promotion, each entrant fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Sponsor and the Administrator, which are final and binding in all matters related to the Promotion.
HOW TO ENTER: By booking your wedding at Novotel and posting required security deposit for event between January 1, 2006 and December 31, 2007, your name will be automatically entered to win. It is not necessary that you hold your wedding between January 1, 2006 and December 31, 2007. If you cancel your wedding prior to the drawing date, you will not be eligible to win.
PRIZES / APPROXIMATE RETAIL VALUE (ARV): All figures are in Canadian dollars. One grand prize will be awarded. The prize will be the cost of your wedding at Novotel up to CDN$10,000.00. If your wedding has already happened as of the drawing date, Novotel will reimburse you for the cost of your wedding up to CDN$10,000.00. If your wedding has not occurred, Novotel will credit you for the cost of your wedding up to CDN$10,000.00. In no event shall Novotel be responsible for paying any amount over CDN$10,000.00 in connection with your wedding.
WINNER SELECTION: Winner will be selected in a random drawing conducted after the conclusion of the contest period, January 15, 2008, from all eligible entries received during Contest Period under the supervision of the independent Administrator. Odds of winning depend on the total number of entries received. Except where prohibited by law, entry and acceptance of a prize constitutes permission for Sponsor to use winner's name, home town, likeness, statements and other personally identifiable information for advertising and marketing of Sponsor's products, services and consumer promotions in any media throughout the world without additional prize, incentive, consideration, consent or review; and upon request, winner will provide written consent to such use. Winners may not transfer, exchange or redeem any Prizes for cash; however sponsor reserves the right to substitute, in whole or in part, a prize of comparable or greater value due to prize unavailability. If any prize is refused, a prize notification is returned or deemed undeliverable, or potential winner is disqualified for any reason, an alternate winner will be selected
DISCLAIMERS & LIABILITY: Sponsor and its agents are not responsible for error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials or any human errors, or for technical, network, telephone, computer, hardware or software malfunctions of any kind, or inaccurate transmission or processing of, or failure of Sponsor or agents to receive entry information. Sponsor reserves the right, in its sole discretion, to cancel or modify the Contest in its entirety, or any portion thereof if its integrity or proper operation is undermined, if becomes corrupted as a result of technical or other reasons or because of any illegal or non-authorized intervention. In such an event, Sponsor will select winners from all eligible entries received as of the date that Contest becomes corrupted. By entering, participants (or if a minor their parents or legal guardians) (a) release Sponsor, its divisions, dealers, subsidiaries, affiliates, and advertising and promotion agencies, Administrator their respective directors, officers, agents and employees from any and all liability for any claims, costs, injuries, losses or damages of any kind caused by their participation, including the unauthorized or illegal access to personally identifiable or sensitive information or the acceptance, possession, use, or misuse of the prize; and (b) acknowledge that said parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, expressed or implied, in fact or in law, relative to the prize including, but not limited to, its quality or availability. Noncompliance with the Official Rules will result in disqualification and the forfeiture if any prize. Any trademarks and names used in this promotion are the property of the respective owners and are used herein for identification purposes only.
INDEMNIFICATION: All entrants hereby agree to forever indemnify and hold harmless hereto Accor and its parents, subsidiaries, affiliates, and their officers, directors, agents, representatives and employees from and against any and all liabilities, claims, causes of action, suits, losses, damages, fines, judgments, settlements and expenses (including reasonable attorney’s fees) collectively referred to as “Claim(s)” arising out of or founded on breach by any party hereto of its obligations, representations or warranties, of by the terms and condition of this contest.
DISPUTES: Entrants agree that any and all disputes, claims and causes of action arising out of, or connected with, the contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Ottawa, Ontario Canada. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant's rights and obligations, or the rights and obligations of the Sponsors in connection with the Contest, shall be governed by, and construed in accordance with, the laws of Canada, Province of Ontario, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than the Province of Ontario.
WINNERS / RULES: To receive Promotion results and/or a copy of these Official Rules, mail a stamped, self-addressed envelope to: Novotel Toronto Centre, Attn: General Manager; 45 the Esplanade, Toronto, Ontario M5EIW2. Specify "winners list" or "rules" on your request.
